1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents aged 18 years or over.
  3. Employees (and their immediate families) of the Promoter, Participating Stores (defined below) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. Entries into the promotion open on 04/11/2024 and close at 11:59pm AEDT on 23/02/2025 (“Promotional Period”).
  5. A “Participating Store” is any BWS or Dan Murphy's store nationally that advertises the promotion and stocks the Eligible Product (defined below) during the Promotional Period.
  6. To be eligible to enter, individuals must purchase one (1) Eligible Product from a Participating Store during the Promotional Period and obtain a purchase receipt (“Qualifying Transaction”). If a staff member does not automatically hand the individual a purchase receipt after making a Qualifying Transaction, it is the individual's responsibility to request one.
    An “Eligible Product” is any 750ml bottle from one of the following Freixenet Italian Wine ranges:
    1. Prosecco D.O.C
    2. Italian Sparkling Rose
    3. Pinot Grigio
    4. Italian Rose
  7. To enter, individuals must then visit Freixenet-Diamond.com.au, follow the prompts to the promotion entry page, input the requested details including first name, last name, email address, phone number, upload the purchase receipt and submit the fully completed entry form during the Promotional Period. Individuals will then be entered into the Major Prize Draw (outlined below in clause 13). Winners of the Instant Win Prizes (outlined below in clause 17) will be notified immediately.
  8. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Eligible Product purchased; (b) each entry must be submitted in accordance with entry requirements; and (c) only one (1) entry permitted per person per day.
  9. Entrants must retain a copy of their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
  10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  11. Incomplete or indecipherable entries will be deemed invalid.
  12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  13. The draw for the Major Prize will take place at Anisimoff Legal, Level 3, 162 Collins Street, Melbourne VIC 3000 on 24/02/2025 at 2:00pm AEDT, in the presence of an independent scrutineer (“Major Prize Draw”). The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
  14. The winner of the Major Prize will be notified by phone and email within two (2) business days of the Major Prize Draw. Winners of the Instant Win Prizes will be notified immediately online upon submitting their entry. All winners will have their initials, surnames and postcodes will be published at Freixenet-Diamond.com.au on 28/02/2025.
  15. The Promoter's decision is final and no correspondence will be entered into.
  16. The first valid entry drawn will win a trip for two (2) adults to Sydney, NSW valued at up to $32,500 depending on date and point of departure (“Major Prize”). Major Prize includes:
    • 2 x return economy airfares from the winner's nearest capital city to Sydney, NSW up to the value of $2,500 (only provided if the winner resides outside of 200kms from Sydney, NSW). If the winner resides within 200km of Sydney, NSW, the Promoter will liaise with the winner to organise parking at the accommodation for 1 night;
    • A jewellery experience at Musson valued at $30,000, including:
      • Return airport transfers or return transfers within a 30km radius as applicable;
      • 1 x night twin share accommodation at the Hilton Sydney with breakfast;
      • Dinner at Glass Brasserie Restaurant & Wine Bar; and
      • Credit to spend at Musson valued at $30,000.
    Additional spending money, additional meals, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Major Prize must be taken by 24/08/2025 and is subject to booking and flight availability. Major Prize cannot be taken during Australian school holidays, public holidays or other peak periods.
  17. Instant Win Prizes”: 5 x $1,000 Digital Vault Pays-enabled Prepaid Mastercard®.
  18. The winner of the Major Prize and their companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the Major Prize. Major Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.
  19. If the winner of the trip to Sydney, NSW resides within a 200km radius of Sydney, NSW the airfare and transfers components of the prize will be forfeited and not redeemable for cash and the winner and their companion must organise their own transport to Sydney, NSW.
  20. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.
  21. Upon verification, the Instant Win Prize will be sent to the winners by SMS (to the mobile phone number specified on the winner's claim form). Winners then need to activate the card using the Vault app – activation code will be provided in SMS. Once activated, the card can be added to the winner's phone's digital wallet (e.g. Apple Pay, Google Pay or Samsung Pay) and can be used for purchasing goods and services where the card is accepted for electronic transactions (excluding transactions at ATMs or over the counter at financial institutions). The card cannot be used as a credit card and cannot be linked to any deposit account.
  22. Any ancillary costs associated with redeeming the Digital Vault Pays-enabled Prepaid Mastercard are not included. The Digital Vault Pays-enabled Prepaid Mastercard must be activated within 2 months of issue and is valid for 12 months after activation. At expiry of the Digital Vault Pays-enabled Mastercard any unused balance will be forfeited. You will not receive notice prior to expiry. Card expiry and balance can be found on your mobile device in your digital wallet.   23. Any ancillary costs associated with redeeming the Digital Vault Pays-enabled Prepaid Mastercard are not included. Any unused balance of the Digital Vault Pays-enabled Prepaid Mastercard will not be awarded as cash. Redemption of the Digital Vault Pays-enabled Prepaid Mastercard is subject to any terms and conditions of the issuer including those specified on the Digital Vault Pays-enabled Prepaid Mastercard.
  24. Subject to the unclaimed prize draw clause, if for any reason a winner does not take / redeem a prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
  25. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  26. Total prize pool value is up to $37,500.
  27. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  28. A draw for any unclaimed prize, including instant win prizes that are won but not claimed, may take place at Anisimoff Legal, Level 3, 162 Collins Street, Melbourne VIC 3000 on 24/03/2025 at 2:00pm AEDT, subject to any directions from a regulatory authority. Winners, if any, will be notified by email and phone within two (2) business days of the draw and their initials, surnames and postcodes will be published at Freixenet-Diamond.com.au on 28/03/2025.
  29. Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any instant win prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw.
  30. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  31. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  32. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
  33. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  34. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use / taking of a prize.
  35. As a condition of accepting the Major Prize, the winner (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  36. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will not use PI for any promotional, marketing, publicity, research and profiling purposes unrelated to the promotion. Information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with can be found in the Promoter's Privacy Policy, which can be viewed at https://www.henkell-freixenet.com.au/privacy-policy-1. For the avoidance of doubt, the Promoter will use PI solely for purposes related to this Promotion and will not use PI for any purpose, detailed in the Privacy Policy, that contradicts this use. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
